This Legal Notice governs access to and use of the website pitchrep.xyz (the "Site") and the AI-powered sales-call training service offered through it (the "Service"). Accessing the Site implies full and unreserved acceptance of these terms. Atlántico Tenerife Asesores, S.L. reserves the right to modify the Site's contents, services and these terms at any time without prior notice.

PitchRep provides a sales-call simulation environment powered by AI models. The Service includes:

• Real-time voice calls with AI-simulated personas.
• Text conversations with AI-generated prospect profiles.
• Live coaching hints during calls and AI-generated performance reviews after each session.
• Management of practice scenarios and the user's business profile.

Nature of AI-generated content. Personas, responses, coaching hints and performance analyses are generated by third-party language and voice models. Such content may be inaccurate, incomplete or out of date. It is intended solely for training purposes and does not constitute legal, financial, commercial or any other professional advice. Users should not base consequential decisions on Service output without independent verification.

Voice processing. Voice-call audio is processed in real time by external AI providers (see section 4). Only the resulting text transcript is stored; Atlántico Tenerife Asesores, S.L. does not retain audio persistently.

Usage limits. The free plan includes monthly caps on voice minutes, hints, reviews, text-to-speech characters and chat messages. Exceeding a cap will temporarily block the affected feature until the start of the next calendar month.

To deliver the Service, Atlántico Tenerife Asesores, S.L. engages the following external providers under legally required GDPR instruments (including Standard Contractual Clauses where applicable):

• Groq, Inc. — generates coaching hints and post-call reviews. Receives the call transcript and the user's business profile.
• Ultravox (Fixie AI, Inc.) — real-time voice call engine. Receives the persona system prompt and processes audio live.
• ElevenLabs, Inc. — fallback text-to-speech. Receives only the text to be spoken.
• Hosting provider — web infrastructure and database. Stores account data and transcripts at rest.

Atlántico Tenerife Asesores, S.L. will not sell or disclose personal data to third parties except upon an express judicial order or request from a competent authority.

All Site contents — including without limitation texts, images, design, source code, logos and trademarks — are the property of Atlántico Tenerife Asesores, S.L. or of third parties who have authorised their use, and are protected under Spanish and EU intellectual and industrial property law. Reproduction, distribution, public communication or transformation of any Site content without prior written authorisation is strictly prohibited, except where expressly permitted by law.

Registered users must provide truthful information and keep their account up to date. Access credentials are personal and non-transferable; users must not share them with third parties and must report any unauthorised access immediately to security@pitchrep.xyz.

Users agree not to use the Service to:

• Carry out unlawful activities or acts contrary to good faith and public order.
• Reproduce or distribute protected content without authorisation.
• Send unsolicited commercial communications.
• Harass, defame or impersonate real individuals.
• Reverse-engineer the Service, scrape it at scale, circumvent rate limits or interfere with other users' access.
• Pass off AI-generated content as a recording of a real human being without their consent.
• Violate applicable export-control or international sanctions regulations.

Establishing hyperlinks to the Site from other websites requires prior written authorisation from Atlántico Tenerife Asesores, S.L. Linking parties may not reproduce Site content or present it in a way that could cause confusion as to its origin.

Atlántico Tenerife Asesores, S.L. does not guarantee the continuity, availability, accuracy or error-free operation of the Service, nor freedom from viruses or other harmful elements. All liability for damages arising from improper or negligent use of the Site by the user, or from interruptions beyond the owner's control, is excluded.

To the maximum extent permitted by law, the aggregate liability of Atlántico Tenerife Asesores, S.L. to the user, regardless of the legal theory applied, shall be limited to the greater of: (a) the fees paid by the user in the 12 months immediately preceding the event giving rise to the claim, or (b) €100. Neither party shall be liable for indirect, incidental, special or consequential damages.

The processing of personal data is governed by Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). The data controller is Atlántico Tenerife Asesores, S.L. These terms are governed by Spanish law. For the resolution of any dispute arising from access to or use of the Site, the parties submit — expressly waiving any other forum — to the courts of Santa Cruz de Tenerife, unless mandatory consumer-protection rules grant the user a different local forum.
